Workers, creamery settle out of court

The Ellsworth Cooperative Creamery has reached an out-of-court settlement with production workers who claimed the creamery violated federal law by not paying them overtime for certain hours they worked.

The Ellsworth Cooperative Creamery has reached an out-of-court settlement with production workers who claimed the creamery violated federal law by not paying them overtime for certain hours they worked.

The case was scheduled for trial last month in Madison, Wis., but just before the attorneys were due in court they phoned the court to say the matter had been settled, according to a court clerk.

Kenneth McMahon, general manager of the creamerry, declined comment on whether overtime compensation practices have been changed.

In the lawsuit filed last summer, 25 unionized employees said the creamery refused to pay them overtime for the 10 minutes they are required to be at work and ready before punching in.
