Court affirms ND farmer's wetlands conviction

A federal appeals court has upheld the conviction of a North Dakota man for improperly draining wetlands that were under easement to the U.S. Fish and Wildlife Service.

A federal appeals court has upheld the conviction of a North Dakota man for improperly draining wetlands that were under easement to the U.S. Fish and Wildlife Service.

The 8th U.S. Court of Appeals rejected claims by Alvin Peterson that the wetlands didn't exist when the easement began and that he was legally draining wetlands that were overgrown and full of silt.

The retired farmer from Lawton was fined $10,000 and given five years’ probation after the misdemeanor convictions in 2008.
