FARGO — A North Dakota farmer says a farm implement company should pay for a combine fire that caused nearly $300,000 in damage.

Thomas Thurlow has filed a federal lawsuit against CNH America LLC. Thurlow says the company was negligent in its design of the 2008 Case IHC combine that caught fire on Nov. 15 near Carrington.

CNH says it should not be held liable for damages and is asking for the case to be dismissed.
